身体权作为独立民事权利之疑义

The Right of Body as an Independent Civil Right Questioned

对于身体权是否为自然人的一项独立的民事权利,文章持否定态度。文章从生命、健康、身体等相关概念入手,着重分析了身体权不应独立存在的理由,并对不同的侵害身体的行为予以定位,以期来弥补法律规定的空白。

AS for us, we have held a negative attitude that the fight of body is an independent civil fight. In this paper,started from life.health.body and other related concepts, more attention is paid on the reason that the fight of body doesn＇t exist independently ,and define different acts against the body so as to make up for gaps in the law.
