摘要
结果加重犯是大陆法系刑法学界一个极具争议的概念,而结果加重犯的未遂问题又是结果加重犯诸多问题中最具争议的问题之一,本文从未遂犯的结果加重犯和结果加重犯的未遂犯这两个概念入手,分析结果加重犯的未遂形态问题。
The offence aggravated consequence is a one of disputed concepts in the criminal law field in mainland. Furthermore, attempted condition of offence aggravated consequence is a one of controversial problems pertinent to offence aggravated consequence. The article tries to start with distinguishing the offence aggravated consequence of attempted crime from the attempted crime of offence aggravated consequence, and analyses the problems on attempted condition of offence aggravated consequence.
