摘要
在当前公共危机发生的频率越来越高,带来的危害越来越大的情形下,危机管理作为政府的一项重要职能和责任,要求在政府的紧急权力与公民的基本权利之间寻找一个平衡点,以有效应对危机并切实保护社会公众的权利和利益。针对我国目前危机管理中政府紧急权力运行和公民权利保护的特点,应加强危机管理法律体系的建设以协调政府紧急权力与公民基本权利的紧张关系,切实保护公民权利。
As an important government function and responsibility, emergency management requests a balance between governmental emergency power and basic civil rights. In view of cu.rrent operation of the government emergency power and protection of the civil rights, this paper puts forward some tentative ideas on how to strengthen the legal system of emergency management to coordinate the relationship between the government emergency power and the basic civil rights, practically protect＇the rights of citizens.
