环境责任保险:环境侵权的社会化救济及其实现路径

On the Path to Build the System of Environmental Liability Insurance

环境责任保险是通过社会化途径解决环境损害赔偿问题的主要方式之一。我国目前环境责任保险的实践存在着一些问题,如制度缺失、规模不大、范围过窄、费率较高等。为了有效的克服这些现实问题,必须从环境责任保险法律体系的构建、环境责任保险市场要素的规制、环境法律意识的培育等几个方面,对环境责任保险制度在我国的实现路径进行研究。

Environmental liability insurance is one of the methods to solve the compensations about environmental impairment by the social channels. At present, the practice of environmental liability insurance, there were some problems, such as drawbacks in the system, the size and scope is too narrow, rates high. To effectively overcome these practical problems, we must research to build a path from a legal system of the environmental liability insurance, regulatory system of market elements, awareness of environmental laws and other aspects of environmental liability insurance system in China.
