论我国团体诉讼制度的构建

Discussion on constructing group litigation system in our country

从公益诉讼入手,通过团体诉讼制度和我国代表人诉讼制度的比较,我们发现我国的代表人诉讼制度中存在着一些制度本身设计的不完善与不合理之处,更重要的是代表人诉讼制度在涉及到公益诉讼方面显得无能为力。随着我国市场经济的快速发展,民众的民主、法治观念的不断加强,社会性团体不断发展与壮大,团体诉讼制度有其存在的合理性和必然性。

Taking measures from public interest litigation, by comparing group litigation system with representative litigation system, finds out there are some incomplete and unreasonable places in our country＇s representative litigation system,more importantly,when comes down to public interest litigation representative litigation system seems to be inefficient. Along with the rapid development of socialistic market economy in our country, the continual enhancement of public democracy and law concept,the constant development of social group,group litigation system will have necessity and reasonability to exist.
