摘要
《物权法》第44条所规定的紧急需要下的土地征用只是土地征用的一种主要而并非唯一的形态;鉴于紧急需要下的土地征用对私人土地权利的影响尤为剧烈,《物权法》司法解释及相关立法应该对该条若干基本问题进行具体界定;紧急需要是一种突发性、公益性的需要;在紧急需要下,土地征用的主体具有广泛性与实用性,但同时也应结合紧急程度、土地面积、土地用途的不同确定不同级别的土地征用主体;土地征用的程序设计以简便、迅捷为宜,但应完整;为公正补偿的需要,土地征用补偿的原则、主体、程序、开始的时间以及补偿金的计算方法等都有必要予以明确。
Land acquisition under the urgent need that the real right law has stipulated is only one main form, and not the only form. In view of the fact that influence is especially fierce that land acquisition under the urgent need to the personal land right. The judicial interpretation of real right law and the correlate legislation should carry on the concrete limitation about the certain basic questions. The urgent need is a kind of burst characteristics and public benefit, Under the urgent need, the main body of land acquisition has universality and the usability, but simultaneously also should unify the urgent degree, the land area, the different determination of land use, land acquisition's main body of different rank. The procedure of land acquisition is best to use simple and fast program, but should be integrity program. To compensation fairly, it is necessary to make any clear about the principle, main body, procedure, time for start and computational method of compensatory payment.
