摘要
社会法作为与公法、私法并列的第三法域,已为越来越多的学者所认可。然而,诸多的社会法基本理论问题在学界依然存在很大争论。这里着重论述社会法产生的基础、社会法的发展历史、社会法的界定、社会法的本位、社会法的价值取向等基本理论问题。
Social law is the third law field, which is in the similar aspect with public and private laws, and is widely accepted by more scholars. However, there are still many debates on basic theoretical issues in the field of social law. This thesis makes some basic discussions on the following issues concerning social law. its origin basis, development history, definition, standard and values.
