The Negotiations for Hostage Crisis in the Perspective of Law

人质危机谈判是解决人质危机的有效手段之一。人质危机谈判中回应劫持者的要求在坚持原则的前提下应讲究谋略,允许向劫持者作出某种承诺。但为了维护国家形象、社会信用和司法公正,这种承诺应受到法律的严格规制。同时,我国刑事立法应规定对自动释放人质减轻处罚,为警方解决人质危机的谈判留下空间。

The negotiations for hostage crisis is one of the effective methods to solve the hostage crisis. The policeman should use the strategy under the premise of persisting the principle when he responds to the hijacker＇s request in the negotiations for hostage crisis and he is allowed to promise the hijacker something. In order to uphold the image of the state, social credibility and judicial fairness,such kind of promise should be strictly regulated by the law. Meanwhile,we must stipulate in legislation the mitigation of the punishment of releasing the hostage on own initiative in order to leave room for the hostage crisis negotiations.
