摘要
同案犯的立功较之于其他犯罪人的立功更加复杂。同案犯立功行为的社会有益性是认定同案犯立功的实质标准,行为具有刑法意义是认定同案犯立功的法律标准,行为实施于犯罪后是认定同案犯立功的时间标准。对于同案犯的立功,除了应当把握一般标准,还要根据具体个案的情况具体分析。
Rendering meritoriousness by the criminals in the case is more complicated than that in other situations. The essential criterion of those deeds is its benefit to the society, the legal criterion of those deeds lies in its criminal significance, and the time of rendering meritoriousness can occur but after the crime been carried into existence. Besides above three criterions, to recognize rendering meritoriousness, specific circumstances must be taken into consideration.
