论公共行政之公共性及其何以可能

On the Publicness of Public Administration and Why It is Possible

"公共性"是公共行政的应有之义,也是政府的合法性基础。本文在对"公共性"的内涵分析及对公共行政中关于"人"之理论预设问题进行考察的基础上认为,现实的社会制度在人们不断地求解"休谟难题"的过程中逐步得到改进,行政的公共性程度越来越高。在此过程中,人自身拥有的人性基础、制度设计的演进与公共精神的培育这三大方面是使实然状态的公共行政向规范性公共行政接近成为可能的最重要因素。

“Publicness” is inherent in public administration, and is also the legitimacy foundation of government. On the basis of anal-ysis of connotation of publicness and presumptions concerning “humanity” in public administration, this article suggests that realistic social institutions are gradually improved when human beings endlessly seek answers to “Hume＇s Problem”, which also leads to higher publicness in public administration. In this process, fundamental humanity inherent in human beings, the evolution of institutional designs, the cultivation of public spirit are the most important factors for increasing public ad- ministration＇s public orientation.
