独立行政法院否定化思考——兼论行政诉讼困境之解决理念

行政诉讼案件的症结所在是司法体制问题。独立行政法院的设立不能从本质上解决行政诉讼所存在的问题。因此,解决行政诉讼案件的难点应放在改变司法机关地位和增强司法机关的独立性上,不必要对现有的行政诉讼案件的审判体制做大幅度的改革。

Crux of the administrative proceedings case is in the judicial system.Establishment of the independent administrative court cannot solve the crux of the administrative proceedings essentially.Therefore,modifying judicial organ status and the enhancement of judicial organ＇s independence are keys to the administrative proceedings case,and it is not essential that make the large reform to the existing administrative proceedings.
