摘要
承租人在使用不动产租赁物给第三人造成的侵权损害,不动产出租人是否承担赔偿责任或连带赔偿责任,必须依据法律的有关规定予以认定。基于合法租赁关系,承租人在使用租赁物给第三人造成侵权损害,出租人应承担违反法定或约定义务的赔偿责任。基于非法租赁关系,承租人在使用租赁物给第三人造成侵权损害,应区分不同情况确定出租人是否承担赔偿责任。在非法的租赁中,不动产租赁物给第三人造成损害,出租人应承担建筑物致人损害的赔偿责任;非法的出租行为导致第三人损害,出租人应承担连带赔偿责任;非法的出租行为没有造成第三人损害,出租人不承担连带赔偿责任。
When a tenant uses real or immovable property and does tort to third party,whether the renter must take on the compensation or jiont obligation or not,h depends on the legal rules.in legal renting realation,the renter must take on compensation of breaking the law or acceptance duty ,but when the renting relation is illegal,it depends on defferent conditions to definite the duty of renter.If the renting relation is illegal,When a tenant uses real or immovable property hurts the third party,the renter must take on duty as the building hurt.The renter must take on jiont obligation if actus injufia hurts the third party,The renter needn't take on any compensation if actus injuria is no hurt to the third party.
