摘要
《物权法》中的建筑物区分所有权是物业管理的法律基础。已经施行4年的《物业管理条例》存在诸多不足。应在《物权法》的基础上,尽快制定专门的物业管理法,明确界定物业、物业管理和业主的范围以及物业管理中的各方关系,规范前期物业管理,明确业主大会和业主委员会的法律地位,完善物业管理制度,促进物业管理的健康发展。
Owners" Partitioned Ownership of Building Areas is the law's foundation of estate management.The regulation of estate management which has come into effect for four years has some defects.The real right law resolves these defects at a large extent. However,because the real right law is the law of which adjusts property relationship,some problems still aren't resolved.In order to perfect and develop the estate management,we should enact estate management law on the basic of real right law;explicit the range of the estate,the estate management,the proprietor,the relationship of every party,preliminary estate management and the legal statuses of proprietor committee and proprietor board.
