On the Theoretical Foundations of Economic Law

经济法的理论基础具有独特性与综合性。基于主体的基本权利在经济法中所处的关键地位和突出作用,可以权利分析为视角进行研究。辩证唯物主义、历史唯物主义是经济法的哲学基础,居于最高指导层次。在学科互动中,社会科学范畴的经济学、管理学、政治学、社会学、法理学、伦理学以及相关自然科学的基本原理,则分别而又共同地为经济法提供操作层次的理论基础。虽然,上述学科对经济法发生理论影响的路径和程度不一,但都不可或缺;我们可以运用系统工程的理论与方法进行整合,构建"经济法理论基础系统"。破解经济法研究领域的这一难题,具有重大的理论意义和实践价值。

The theoretical foundations of economic law are unique as well as comprehensive. They can be studied from the perspective of analysis of rights because the fundamental rights of subjects play a crucial and prominent role in economic law. Dialectical materialism and historical materialism constitute the philosophical foundations of economic law and therefore the ultimate guiding principles. Meanwhile, in the disciplinary interactions, the basic principles of social sciences, such as economics, management science, political science, sociology, jurisprudence and ethics as well as related natural sciences, serve respectively and jointly as operational theoretical foundations for economic law. Although the route and extent of the theoretical influence from the above-mentioned fields on economic law are different, none of those fileds is indispensable; we can use the theory and method of systems engineering to construct the ＂System of Theoretical Foundation of Economic Law＂. This approach will prove of significant theoretical implication and practical value in our efforts to resolve complex problems in the research of economic law.
