偏离与调适:规范民族区域自治运行——兼以西南地区E自治县为例

Deviation and Adjustment:Regulation of the Operation of the Regional Ethnic Autonomy and An Example of the County E in the Southwest

文章从公共政策的视角来探讨民族区域自治,以公共政策执行偏离为分析框架分析民族区域自治运行中的偏离,用E县为个案阐述了民族区域自治运行中的五种偏离表现:自治权的旁落,自治立法权行使混乱,变通权行使缺失,自治条例监督、保障机制缺失和自治机关的权力与责任、权利与义务不平衡;分析了产生偏离的原因,并提出从党政职能分开获得体制支持,增强自治意识形成精神动力,完善法制建设、提供制度供给和提升行使自治权的能力、培养驾驭技巧四个方面来规范民族区域自治运行。

This paper analyzes the deviation in the operation of the regional ethnic autonomy under the framework of the executive deviation of the public policy from the angel of the public policy.On the basis of the case study of the county E,the paper discusses five forms of the deviation:loss of the autonomous power,mixture of the exercise of autonomous legislation,loss of power of adaptations,loss of system of guarantees and supervision of the autonomous regulation,and uneven of the power and responsibility as well as right and duty of the autonomous organs.The author analyzes the reason of the deviation and puts forward the advices to regulate the operation of the regional ethnic autonomy.The advices are to separate the functions of the Party from those of the government to get the support of system,to enhance the sense of autonomy to build motive force,to improve legal system to give the institution supply,and to promote capability of autonomous organs and develop the technique.
