试析我国村委会的法律地位及其现实问题

A tentative study of the legal property of the Chinese village committees

我国村委会数量众多,而村委会的法律地位在法律上无明确而详细的规定,导致实践中遇到诸多法律问题,我国村委会从宪法组织法角度看属于"基层群众性自治组织";从行政法角度看,属于法律法规授权的一类组织;从民法的角度看,不具有法人地位,属于"其他的组织"。在现实中,存在着与基层政权、基层党组织及行政主体与非行政主体的冲突。

There are an uncountable number of village committees in China, but their legal properties remain unknown in the law, which results in frequent legal confrontations in practice. The writer of the paper aims to define the legal status of the village committees, and find the approaches or solutions to the problems faced by the village committees.
