摘要
《中华人民共和国物权法》将农村土地承包经营权明确为用益物权,对于保护农民的土地权益具有十分重要的意义。但从实践来看,并非土地承包经营权一经物权改造,原来所存在的土地承包纠纷问题就都会得到解决。物权法的改造只是相对原来债权保护来说效力更具对世性,范围更具广泛性。
The Chinese real right law is issued in March 2007, which defines the management right under the land lease as real right. This is quite influential in terms of the protection of the right of farmers to use the land. Yet in effect the real right law cannot solve all the problems in the land leasing. So the paper begins with the real right law to discuss the nature of the right of land lease,
