Functions of Economic Analyses in Judicial Litigations

经济学作为一种"制造理解"的工具,在诉讼中可以发挥很大作用。这种作用至少表现在两个方面:一是有助于认定案件的事实依据,二是可以为法官裁决提供参考标准。这种作用具有很强的现实性和可操作性。所以,经济分析对于法官来说非常重要,法官必须具备一定的经济分析能力。

Economics as an analysis tool can play a significant role in lawsuits. Its role is manifested in at least two aspects： firstly it is helpful in recognizing the factual basis of a case; secondly it may provide a reference standard for the judge＇s ruling. This function is of great feasibility and operability. So economic analyses are of great importance to judges and judges must have considerable ability in economic analysis.
