摘要
著作权法保护的是作品的具体表达,既包括表达形式也包括表达内容。将提高社会的公共利益作为著作权法的立法价值基石,可以避免概念法学定性思维的短处,从而有效地筛选著作权法所保护的表达的外延。
Copyright Law protects the specific expression of works, including both form and content of the expression. It could avoid the shortcomings of the fixed though of the conception law if we take the protection of public interest as legislation basis. As a result, the outer range of the copyright protection can be defined effectively.
