摘要
在我国的民事诉讼及行政诉讼中，“举证原则”是一个十分重要的诉讼原则。
《民事诉讼法》第64条规定：“当事人对自己提出的主张，有责任提供证据。”
最高人民法院于2001年12月公布的《关于民事诉讼证据的若干规定》第二条又进一步规定：“当事人封自己提出的诉讼请求所依据的事实或者反驳封方诉讼请求所依据的事实有责任提供证据加以证明。
The burden of proof is one of the very important litigation doctrines in the civil and administrative procedures in China. Article 64 of the Civil Procedure Law of the People＇s Republic of China provides that ＂an interested party shall be under the burden of proof with respect to his claims.＂ Article 2 of the Several Provisions Concerning Evidence in Civil Procedure issued by the Supreme People＇s Court （SPC） in December 2001 further specifies that ＂a party shall be under the burden of proof to prove the facts on the basis of which he makes his litigant claims or allegation, or rebuts another party＇s litigant claims or allegations.
