最高人民法院关于审理注册商标、企业名称与在先权利冲突的民事纠纷案件若干问题的规定

Supreme People＇s Court＇s Provisions Concerning Several Issues Relating to Trial of Civil Cases of Dispute Arising from Conflicts between Registered Trade Marks or Enterprise Names and Prior Rights

为正确审理注册商标、企业名称与在先权利冲突的民事纠纷案件，根据《中华人民共和国民事诉讼法》、《中华人民共和国民法通则》、《中华人民共和国商标法》和《中华人民共和国反不正当竞争法》等法律的规定，结合审判实践，制定本规定。

With a view to duly hearing civil cases of dispute arising from conflicts between registered trademarks or enterprise names and prior rights, these Provisions have been hereby formulated under the Civil Procedure Law of the People＇s Republic of China, the General Principles of Civil Law of the People＇s Republic of China, the Trademark Law of the Peo- ple＇s Republic of China, and the Unfair Competition Law the People＇s Republic of China, and with reference to the judicial practice.
