On the Relationship between Intellectual Property and Competitive Law

知识产权在现代经济中的作用和地位迅速提升,竞争法作为现代市场经济的基本法,始终保持着对知识产权的密切关注,其两大组成部分反不正当竞争法与反垄断法,一个在知识产权法保护基础之上,对知识产权法未能顾及到的与知识产权相关的领域给予补充保护;另一个在肯定知识产权的垄断性专有权性质的同时,又对超出合理行使界限的知识产权滥用行为给予限制。两者相辅相成,实现了竞争法对知识产权的保护扩张和保护限制。

Along with the rapid development of world economics integration, the status of intellectual properly rights has been promoted rapidly in modern economy. As the fundamental law of modern market economy, competitive law is maintaining close attention to the intellectual property rights, of its two major constituents, unfair competitive law provides supplement protection with the intellectual property correlated domain; and the antimonopoly law gives limit to the behavior of copyright abusing. Above all, they work together to realize the expanding and limit of competitive law to the intellectual property rights.
