On Heterogeneity of Penalty and Correction

刑罚理论和实践中一直将矫治视为刑罚的重要制度以及行刑社会化的重要手段。"刑罚意味着矫治犯罪人"这种认识实质上混淆了刑罚与矫治的关系。刑罚与矫治的异质性,表现在刑罚与自由刑的关系、劳动的刑罚解读、矫治的刑罚独立性理性分析、刑罚与矫正混淆的实践危害性等几个方面。矫治的刑罚独立化理论是解决目前理论界关于刑罚本质报应论与矫正论争议的关键所在。

Correction is regarded as the important system of penalty and the important means of socialization in theory and practice of penalty. This kind of tmderstanding that penalty means correct offenders confused the relation between penalty and correction. The heterogeneity of penalty and correction is showed ： the relation between penalty and free sentence, interpreting the penalty of labor, the rational analysis of penalty independence of correction, the confusion of penalty and correction and so on. The theory of independence of penalty of correction is the key of solving the controversy of the theory that penalty in essence is a kind of retribution and correction.
