中西部农村基层法律服务业的困境——以赣南石镇为例

The Difficulty of Grassroots Law Service Business in Western Central Rural China

农村基层司法所/法律服务所对于中国法治实践有着重要意义。赣南石镇的实证材料表明,刚刚实现"两所分离"的乡镇司法所和法律服务所都处于困境之中。在诸多因素的合力下,农村基层法律服务市场日益缩小,而法律服务所在其中的竞争力还在不断降低;司法所则随之处于司法行政机关和乡镇政府的"条块矛盾"中,受到了财政来源方面的压力。可以说,在中西部农村经济欠发达的情况下,当前"两所分离"的相关改革使得中西部农村基层法律服务业处于困境之中。

The grass-roots Judicial Administrative Stations are very important in China＇s legal practice. The social survey of Shi Town, Jiangxi, shows that Judicial Administrative Stations and Law Service Stations are both in difficulty since they were separated. The law service market is contracting increasingly, and Law Service Stations＇ competitiveness is weaker. The Judicial Administrative Stations are subject to the pressure of public finance sources due to the contradictions of “vertical and horizontal administration”.
