摘要
我国现实中时常发生业主与开发商之间关于车位车库权属的纠纷。《物权法》第74条将约定方式作为判断车位车库归属的依据,但是由于其理解上的困惑,仍然存在着发生纠纷的必然隐患。在规划的车位车库可能属专有也可能属共有的情况下,应当以规划蓝图中载明的专有或共有的用途作为判断的依据,应当在准确理解专有的车位车库与建设用地使用费分摊关系的基础上,正确处理车位车库的归属问题。
The ascription of garage and parking lot in China. Based on the parties' contract in terms causes the dispute between the house owners and land developers of the article 74 of Property Law, the ascription of garage and parking lot is in hidden trouble since the explanation for the rules of the article 74 is bewildered. Under the circumstances that garage and parking lot may be the teileigentum or sondereigentum, the pui'pose written down in the blueprint should function as the judgment standard. Moreover, only when we well understand the relationship between the exclusive garage and parking lot and the construction usufruct toll are we able to deal with the issue of the ascription correctly and apply the article 74 correctly.
