On Hedge Fund's Cross-Border Operation and International Regulation

对冲基金的跨国活动带来了国家主权与经济安全、法律冲突等一系列问题。国际证券委员会组织、巴塞尔委员会、国际货币基金组织等国际金融组织对此付诸了努力,但实质性成果尚微。推动对冲基金国际监管合作应当以建立新的国际经济秩序为基本原则,着重加强国际货币基金组织的建设,建立全球性和区域性的国际金融风险防范体系。

Hedge fund＇ s cross-border operation brings about several legal problems, such as sovereignty and economic safety, legal collision and anti-money laundering. However, not so much substantial progress has been achieved within this field , in spite of the continuing efforts of international financial organizations such as IOSCO, Basel Committee and IMF. Promoting the cooperation herein requires that the construction of IMF should be intensified in light of creating a new order of international economy. And it is also necessary to set up both global and regional international precautionary mechanisms for financial risks.
