我国高校独立学院的委托-代理问题初探

On the Trusteeship-Agency of the Independent Colleges in Higher Education Institutions in China

目前,高校独立学院委托人及代理人存在身份界定不明确、职责不清、机构不独立和无约束激励机制等情况。因此,高校独立学院应改革产权制度,明确产权主体与责权利关系,规范委托人和代理人行为,规范学院内部激励机制;加强董事会、监事会的建设,维护高等教育的公益性。

Problems arise in independent colleges in higher education institutions such as the status of trustees and agents unclearly defined, their obligations and responsibilities unspecified, independent colleges not autonomously operated, restraint mechanism and incentive mechanism not established, and so on. To maintain the public welfare of higher education and to perfect the trusteeship-agency in independent colleges, measures have to be taken to reform the property system, to specify the subjects of property, their rights, obligations and benefits, to stipulate the trustees and agents＇ norms of conducts, to regulate the incentive system, and to enhance the construction of the board of directors and supervisors.
