摘要
本文系法律语言学研究,运用评价理论所建构的警察讯问介入系统,分析三起刑事案件的讯问笔录,并阐释警察在讯问不同类型的犯罪嫌疑人时所采用的介入模式和所体现的人际意义,即立场、态度和观点。此项研究旨在探讨如何通过人际意义的调节来实现讯问的程序正义,以保障犯罪嫌疑人的合法权益,避免对特殊类型犯罪嫌疑人,尤其是家庭暴力受害人造成二次伤害。
This paper presents a forensic linguistic study,from an Appraisal-Engagement perspective,on the interpersonal meanings expressed or implicated in police interrogations or interviews with criminal suspects in the Chinese context.An analysis of authentic data reveals that police use different modes of engagement(dialogic contraction versus dialogic expansion) and take differing stances(subjective versus intersubjective) when interacting with different types of criminal suspects.To safeguard the suspects' legal interest and their right to speech,and to avoid revictimization of special types of suspects,this paper argues for the dialogically expansive police interviewing with suspects rather than the dialogically contractive police interrogations of suspects.
