2001年美国发生"9.11"事件后,布什政府把恐怖主义看作头号威胁,并发起了针对恐怖分子的"反恐战"。美国的反恐战引发了国际社会对有关战争法与国际刑法、自卫权与先发制人攻击、战俘身份认定与监禁措施以及酷刑审讯行为等一系列问题的法律和政治思考,并对布什政府的立场提出了广泛的质疑。
After the 911-terror attacks, the US government launched military operations in Afghanistan and Iraq as parts of its policy of 'war on terror'. The policy gave rise to disputes in international law including laws of war and international criminal laws, doctrines of self-defense and preemption attack, the identification and custody of war prisoners, and the excruciation of captives. The essay analyses the negative influence of such policy and concludes that the attitude and actions of Bush administration thereupon lead to international condemnations.
