摘要
劳动法上的所谓劳动,乃是劳动力所有者在与资本所有者订立用工契约让渡自己的劳动力使用权的前提下,按照契约约定或用工者及其代理人的管理指令所从事的具有人身隶属属性和协作分工性质的相关工作或活动。它具有劳动内容的约定性、劳动活动的内部分工性、劳动成果的分配性和劳动保护的强制性等法律特征。
The so-called labor in labor law, is the labor ownership and the capital proprietor through make the labor contract to transfer itself labor usage rights, according to the contract promise and management instruction by capital proprietor or its agent, be engaged in work or activities which related with subjection and cooperation . It have many legal characteristics,such as labor contract content;labor behavior belong to divide the work, labor production must be distributed, and labor protective compulsive, etc.
