转化抢劫罪是抢劫罪的一种特殊类型。在立法技术方面,转化抢劫罪属于法律拟制,二者在罪质方面具有同一性。因此,成立转化抢劫罪必须具备:一是实施盗窃、诈骗、抢夺行为;二是当场实施暴力或以暴力相威胁的行为;三是主观目的是为了窝藏赃物、抗拒抓捕或者毁灭罪证。"当场"是指盗窃、诈骗、抢夺行为现场以及其行为"延长线"所涵盖的场所。
