农村宅基地使用权流转推阻机制分析

Analysis on the Driving and Interruptive Mechanism of Rural Residential Land Userights' Transfer

按规定,农村宅基地只有在农村集体组织内部和国家征收征用时流转,但实际上农村宅基地的流转十分普遍,特别是在城市郊区。文章分析了农村宅基地流转的驱动力和阻滞力,认为驱动力包括三个不同主体,即国家征收征用驱动力、农村集体组织转用流转驱动力、农户自发流转驱动力,主体不同驱动力不同。阻滞力包括制度阻滞力和区位阻滞力。

According to the regulations, the base of rural residence can only transfer inside the rural collective organizations. But actually, the transfer of rural residence is very common, especially in urban areas. This paper analyses the driving force and the interruptive force of the transfer of residence base. We regard that the driving force includes three different aspects that drive collected by the state expropriation, the rural collective organizations, farmers, and different principal part makes the different force. And also, the interruptive force includes two different force that drive by the system and location.
