摘要
"经济人"的"寻租"动机、市场中"租"的客观存在以及监管制度的缺陷等是贿赂犯罪产生的原因。治理贿赂犯罪,必须完善和加强法律制度建设,从增加贿赂犯罪的违法成本入手,严密法网,加大打击力度,提高惩罚几率。基于对《刑法修正案(六)》的分析和评价,文章认为,应对刑法中有关贿赂犯罪的规定予以整合,将商业贿赂与公务贿赂合并统一为行贿罪和受贿罪,并进一步完善贿赂犯罪的有关规定。
The motive for seeking rent, the existance of rent in the market and the limitation of supervision system combine to result in bribery crime. To control this, it is necessary to improve the legal system. Not only should we increase the cost of bribery crime, but also complete the network of justice, strengthen suppression and punishment. While the Amendment WI of the Penal Law results in a systematic disharmony in the Penal Law, it is necessary to integrate the regulations on bribery punishments and make further amendments to the relevant regulations.
