苏州历史文化遗产保护中的产权问题

The Issue of the Property Rights of the Protection of Historical and Cultural Heritage of Suzhou

利用新制度经济学的产权理论,在新颁布的《物权法》对历史文化遗产保护的新要求下,分析了苏州历史文化遗产的产权现状,借鉴苏州市的成功经验,探讨如何根据历史文化遗产的性质重新合理划分其产权所有者,以及如何激励产权所有者投入历史文化遗产保护事业。

By using the theory of property dghts of the new institutional economics and based on the new request of the ＂Property Law＂ newly promulgated in the protection of historical and cultural heritage,the article analyses the status quo of historical and cultural heritage of the property rights of Suzhou,and discusses the ways to define the owners of property rights reasonably according to the nature of historical and cultural heritage from the successful experience of Suzhou, as well as how to encourage the owners of property rights in the cause of protection of historical and cultural heritage.
