Juvenile Delinquency and the Applied Penalties

未成年人犯罪已成为当今世界的一个十分严重的社会问题,对未成年人犯罪的处罚也一直是各国刑法共同关注的问题。文章从我国刑法关于未成年人犯罪的处罚原则入手,着重分析了在刑法中可以适用及不适用的刑种,提出可以加大推广非刑罚手段的适用。

Cases concerning juvenile delinquency take a certain proportion in all the criminal cases today. However, for a juvenile delinquent, the charge of criminal responsibilities and the application of penalties are strikingly different from those for an adult criminal. Starting from the penalty principle to juvenile delinquent, this papers analyzes the kinds of punishment which can or cannot be applied to them, and puts forward that non- penalty means can be popularized.
