社区矫正,是一种非监禁刑罚执行活动、是当今世界各国刑罚制度的发展趋势,为许多国家所采用。社区矫正制度在我国还没有完全确立,尽管我国的刑事法律规定了非监禁刑罚执行措施,但与社区矫正的要求相去甚远。文章就我国当前社区矫正的现状及其制约因素,对建立具有中国特色的社区矫正制度从在现有的法律框架内和突破现行法律框架两个方面提出了完善建议。

The community correction is a development tendency for one kind of non - imprisonment penalty in various countries penalty system now. The community correction system has not been completely established in our country, although our country criminal laws have ruled the non- imprisonment penalty measure, but it is not enough for the community rectifies. In view of the present situation and its restriction factors, the article consummates the suggestions to establish community correction system with Chinese characteristic in the existing legal frame and the breakthrough of present law frame.
