摘要
受社会舆论、教师素质以及法律不健全等各种因素的综合影响,教师惩戒权在教育实践中出现了被滥用和不作为两种极端的错误倾向,这不仅是对教师权益的毁损,也是对学生权益的侵害。真正实现教师对惩戒权的行使,既需要加快教育法治的进程,也需要提高教师和学生的素质、改善全社会的教育环境。
By the combined effects of various factors such as public opinions, the quality of teachers, as well as relevant laws, teacher's right of punishment in the educational practice usually means the act either of abuse or of omission. This does harm to both teachers' and students' rights. In order to change the situation, the development of the rule of education law should be accelerated, the qualities of teachers and students should be improved, and the education environment should be upgraded.
