我国民事司法救助制度的评析

Remark on Civil Judicial Aid in Our Country

基于公民平等的司法保护请求权而产生的司法救助制度,旨在保护弱势群体的合法权益,体现社会的公平与正义。我国的司法救助制度还存在一些缺陷,导致国家建立制度的初衷与实现当事人裁判请求权的理念出现脱节,有待于逐步完善。

Emerging from protecting the claim of citizens＇ equality, the judicial aid system aims at protecting the legitimate rights and interests of vulnerable groups, which reflects social equity and justice. However, there are still some shortcomings in China＇s justice system which makes the original intention of establishing national systems divorce from the concept of realizing the parties＇ right of claim. Therefore, it still remians to be improved step by step.
