Evolution of Idea/Expression Dichotomy in the New Era

思想表达二分法是版权法中最基本的原则之一。从利益平衡的角度来看,思想/表达二分法及其后发展出的"融合""通用元素"等限制原则,在未明显损害作者利益的基础之上,有利于保障公共公益和社会福利,因而具有相当大的合理性。其趋于灵活的处理方式,也为其在新时代的发展注入了新的活力。

This paper examines idea/expression dichotomy, one of the key principles of copyright law, by giving a close scrutiny to different interests under the Dichotomy as well as the possible unfavorable outcomes. We come to the conclusion that idea/expression dichotomy, along with sub-principles such as ＂Merger＂, have justly balanced different inter- ests, promoted social progress, and ensured public interests and social welfares. The idea/expression dichotomy is of great rationality, and its flexibility can ensure its evolution in the new ear.
