在中国仍保留死刑这一客观形势下,无论是死刑废除论者,还是死刑存在论者,都开始将研究点转到死刑适用程序上,希望通过构建死刑正当程序来限制死刑。在参考许多学者对死刑正当程序研究的基础上,对死刑正当程序的含义进行论述,分析其中的部分不合理因素,并提出相应的改革构想。

Under the objective situation of China still retains death penalty, the scholar begin to study the suitable program of death penalty, hope to find the rightful program of death penalty to restrict death penalty. Referring to scholar theory for the rightful program of death penalty, we need to carry out the meaning of the rightful program of death penalty , analyze the nonreasonable factors and put forward to reform conception correspondingly.
