阐释真实的法律生活——论法人类学对纠纷的研究 被引量：2

摘要 早期法人类学研究法律演变的进化模式和原始法‘规则’。马林诺斯基开始描述现实法律生活即纠纷。纠纷的研究采取"规则中心",以及"过程中心"路径。最近的研究不仅关注"规则"和"过程"的结合,而且综合运用历史、文化、制度、文本分析等各种方法多向度解读、分析和审视纠纷,以阐释真实的法律生活。
