摘要
讨论信息获取权利作为一种新权利的来源及其与信息权利的区别。介绍各国信息公开法对信息获取权利的规定。讨论信息生产者或拥有者的信息权利和信息使用者的信息权利这两种信息权利观,说明信息公开法主要依据后者。论证保障公民信息获取权利是公共图书馆制度和政府信息公开制度的共同基础。
This paper discusses the right of access to information as a source of new fight, the right of information and its distinction, and introduces this right in the freedom of information （FOI） in several countries. Two values of right of information are discussed, called right of beneficiary and right of obliges. The latter bases FOI. The institution of public library, like FOI, ensures public＇s right of access to information.
