Interests,Rights and Law——On Women's Law by Four Mechanisms

结合妇女法的相关规定及其运行状况,从利益切入,可对四大机制作出新的解读:利益协调机制切中了妇女从立法层面维权的法律之源,诉求表达机制侧重于妇女从法律层面主张利益要求,矛盾调处机制和权益保障机制则从法律运作层面分别把调和涉及妇女利益的冲突和救济妇女利益缺损视为判定标准。

With the legislation and enforcement of women＇ s law, this article offers a new interpretation on four mechanisms in the view of interests. The author believes that the mechanism of interests coordination points out the legal source that why women fight for rights; and the mechanism of demand expression focuses on the interests demands of women at the level of legislation; the mechanism of conflict mediation and the mechanism of protection of rights and interests treat the conciliating interests conflicts and remedying lost interests for women as criterion at the level of legal enforcement.
