论和谐社会背景下我国弱势群体保护与政府责任

On Protecting Vulnerable Groups in China and the Government's Responsibilities in a Harmonious Society

加强弱势群体保护在构建社会和谐中具有重要作用。我国已经初步建立弱势群体保护的法律制度,但是在弱势群体保护中也存在法律的规定过于原则,适用对象狭窄,社会保障权利缺失,法律实施薄弱等问题。弱势群体保护是政府义不容辞的责任。目前,加强弱势群体保护,需要树立弱势群体保护新理念,贯彻平等原则和倾斜保护的原则,构建完善的法律和政策体系,强化政府公共服务职能,健全权利救济制度。

Strengthening the protection of vulnerable groups is of importance in constructing a harmonious society. Although China has established an initial legal system for protecting vulnerable groups, there still exist many problems. For example, the law principle is overly abstract, the scope of protected people is narrow, the right of social protection is lacking, the law enforcement is weak, and so on. Protecting vulnerable groups is an unshirkable responsibility of the government. At present, it is necessary for strengthening the protection of vulnerable groups to establish a new idea of protecting vulnerable groups, to implement the principles of equal protection and inclined protection, to set up an improved system of law and policy, to strengthen functions of public service of the government, and to improve the rights remedy system.
