论责任伦理的价值——基于新公共服务范式对自由裁量权规制理路的解读

On Value of Responsibility Ethics:The View in the Regulations of Administrative Jurisdiction Based on the New Public Service Theory

随着现代社会发展的需要以及对公共行政现代性的追寻,行政自由裁量权的合理性价值及其限度日益凸显。20世纪末,西方的新公共服务等理论范式对伦理价值的关注,无疑是解决此问题的一盏指路明灯。在制度之外辅以一种建基于内在道德信念的自我约束机制——责任伦理,契合了公共行政道德化趋向。责任伦理作为行政自由裁量权价值生成与公正运用的基本前提与保障,可确保行政自由裁量权以一种符合民主、公正要求的负责任的方式行使。

With the development of modern society and the pursuit of the modernity of public administration, the rationality value and limitation of the administrative jurisdiction is standing out. The new public service theory is no doubt a lamp that can help to find the so- lution to the problem, which attaches much importance to the value of ethics at the end of the 20th century. We propose responsibility ethics, besides regulations, which is a self-coordination mechanism based on inner spirit and works as the basic premise of creating value and fairly conducting administrative jurisdiction, and reacts the trend of eublic-administration moralization. Thus we can make sure that the “free verdict” is conducted democratically, fairly and responsibly.
