约定竞业限制是保护商业秘密的重要手段,但其可能会与公共利益产生冲突,如果被滥用则会损害雇员的劳动权和择业权。所以,对约定竞业限制的内容应进行合法性的考量。
The stipulation of competition restriction is the important method of protecting commercial confidential. However, it may conflict public benefit. The abusing of it may damage the labor right and job selecting right of the employee. Therefore, the content of the stipulation of competition restriction should be weighed lawfully.
