浅议新律师法的立法缺陷

新律师法的修改,解决了旧律师法和现行刑事诉讼法都未曾解决的问题,赋予了律师更多的权利,大大改善了律师的职业环境。但本文认为,新律师法同样存在立法不完善的缺陷,新律师法未规定律师办理案件进程知情权,未规定律师提供法律咨询的豁免权,对律师的管制更加严格。文章最后认为,不能希望于对新律师法再做修改,而应在刑事诉讼法修改中予以补救。

The new amendment to the Attorney Law has solved the problems that both the old Attorney Law and the current Criminal Law have more rights and has greatly changed their profession failed to solve, has endowed lawyers with environment. But this paper holds that the new Attorney Law also has flaws due to incomplete legislation. The new Attorney Law does not support lawyers＇ right to know in the process of handling law case and the immunity right to provide law consultation. Instead, it regulates the lawyers more strictly. Then this paper will conclude with this belief that we should find a way out by remedying the criminal law instead of hoping to do more amendments to the new law..
