对我国离婚损害赔偿制度的反思

On Damage Compensation System for Divorce in China

2001年《婚姻法》修正案创设了离婚损害赔偿制度,其立法目的在于针对现实生活中出现的一些新问题,更全面地保障婚姻当事人的合法权益。但从司法实践的情况来看,效果很不理想。究其原因,主要是由于制度本身存在严重缺陷。因此,应当舍弃当前的离婚损害赔偿制度,而以离婚扶养制度取代之。

Damage Compensation System for divorce was established in Marriage Law Amendatory 2001 to more fully guarantee the legal right of parties of marriage against some new problems. It has been finding that the system brings effect much less good as expected due to the serious defectives of the system itself. It should be abolished and replaced by the Comparison of Maintenance System.
