摘要
物权法律制度与环境法律制度的融合以及在物权法中引入有关环境保护的规则是现代物权法的重要发展趋势。《物权法》必须以保护环境,维护生态文明作为其一项重要任务,这就决定了《物权法》在注重充分发挥资源的有效利用的前提下,强调合理利用资源、保护环境,维护生态平衡,体现了中国物权法的本土化和其先进的理念。
The integration of property rights legal system and environmental legal system and the introduction of rules concerning environmental protection in property law is an important trend in modern property law. Property Law must take protecting environment and maintaining ecological civilization as an important task, which determines that under the premise of focus on the effective use of resources Property Law emphasizes on the reasonable use of resources ,environmental protection and safeguarding ecological balance. It reflects the localization of the Chinese property law and its advanced concepts.
