摘要
超市收取上架费是产品分销中零售商对供应商拥有相对优势地位的结果,是零售商相对优势地位滥用的表现。上架费的竞争法规制应建立在合理分析基础之上。在经济分析不能提供明确答案的情况下,竞争和消费者利益应为反垄断法规制上架费首先要实现的目标。如何利用我国反垄断法规制上架费,应对该法第三章"滥用市场支配地位"做合理解读。
The charging of slotting allowance by supermarkets is the result of abuses of buying power enjoyed by supermarkets in product distribution process. The regulation of slotting allowance should be based on the analysis by the rule of reason. In case of economic analysis providing no clear guide lines, competition and consumer welfare should be the first two goals to be achieved. The regulation of slotting allowance with the application of Anti-monopoly Law should be relied on the reasonable interpretation of Chapter Three “the abuse of dominant market position. ”
